PRIVACY POLICY

  1. Introduction. Accolade Corporate Services Limited (“Accolade”, “we”, “us”, or “our”) is committed to protecting and respecting your privacy. We comply with the Personal Data (Privacy) Ordinance (Cap. 486) of the Laws of Hong Kong (“PDPO”) and, where applicable, international privacy laws. This Privacy Policy explains how we collect, use, process, and disclose your Personal Data when you access our website, use our services, or interact with us.

By visiting our website or using our services (including Company Formation, Company Secretarial, and Intellectual Property services), you accept and consent to the practices described in this policy.

  1. Definitions
  • “Personal Data” means any data relating to a living individual from which it is practicable for the identity of the individual to be directly or indirectly ascertained, and in a form in which access to or processing of the data is practicable.
  • “Services” means the corporate services, including but not limited to company incorporation, intellectual property registration and management, business search, due diligence, HR and payroll, and accounting and tax support provided by Accolade.   
  • “Data Subject” means the individual who is the subject of the Personal Data.
  1. Collection of Personal Data.We may collect and process the following data about you:
  • Information you give us: You may give us information about you by filling in forms on our site (www.accoladegroup.com.hk), by corresponding with us by phone, email, or otherwise, or by engaging us for Services. This includes information you provide when you chat with us thru our site, subscribe to our service packages, or report a problem with our site. The information you give us may include your name, address, email address, phone number, passport number, Hong Kong Identity Card (HKID) number, any other identification card, and financial information.   
  • Information we collect about you: With regard to each of your visits to our site, we may automatically collect technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform.
  • Information we receive from other sources: We may receive information about you if you use any of the other websites we operate or the other services we provide. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them.
  1. Purpose of Processing.We use information held about you in the following ways:
  • To provide our Services: To carry out our obligations arising from any contracts entered into between you and us, such as the incorporation of companies, filing of Annual Returns, or registration of Trademarks.   
  • Regulatory Compliance: To comply with our statutory obligations, including “Know Your Customer” (KYC) checks, Anti-Money Laundering (AML) screenings, and the maintenance of the Significant Controllers Register (SCR) as required by the Companies Ordinance.   
  • Communication: To provide you with information, products, and services that you request from us, or which we feel may interest you, where you have consented to be contacted for such purposes.
  • Site Improvement: To ensure that content from our site is presented in the most effective manner for you and for your computer.
  • Security: To protect our platforms and services from fraud and unauthorized access.
  1. Sharing Information Outside of Accolade. We may share your Personal Data with:
  • Affiliates: Any member of our group, which means our affiliates, subsidiaries, our ultimate holding company and its subsidiaries, as defined in Schedule 1 to the Securities and Futures Ordinance, including our offices in Singapore, Malaysia, Mainland China, Philippines, Macau, and Taiwan.   
  • Strategic Partners: Selected third parties including business partners, suppliers, and sub-contractors for the performance of any contract we enter into with them or you (e.g., courier services, cloud hosting providers).
  • Regulatory Authorities: The Companies Registry, Inland Revenue Department, Intellectual Property Department, and other competent authorities where we are under a duty to disclose or share your personal data in order to comply with any legal obligation.   
  • Professional Advisors: Our auditors, insurers, external legal advisors, and bankers, but only to the extent necessary for them to provide their professional services to Accolade (e.g., for internal and financial audits, insurance claims, or banking compliance).
  1. 6. Consent. By providing your Personal Data to us, you consent to the collection, use, and disclosure of that data as set out in this Privacy Policy.
  • Direct Marketing: We will strictly adhere to the requirements of the PDPO regarding direct marketing. We will only use your personal data for direct marketing (e.g., newsletters about tax regulation changes, IP law changes, trademark maintenance and renewal deadlines) if we have obtained your consent or indication of no objection. You have the right to opt-out of such marketing at any time.
  • Withdrawal of Consent: You may withdraw your consent for the collection, use, or disclosure of your personal data at any time by contacting our Data Protection Officer. Please note that if you withdraw your consent, we may not be able to continue providing you with our Services.
  1. Disclosure of Personal Data.We strictly limit the disclosure of your Personal Data. We do not sell, trade, or otherwise transfer your Personal Data to outside parties for their independent marketing purposes. Disclosures are strictly limited to those necessary for the provision of our Services or compliance with the law.
  2. Security of Personal Data.We use a variety of security technologies and procedures to help protect your personal data from unauthorized access, use, or disclosure.
  • Physical Security: We maintain strict physical control over our offices and storage facilities where statutory books, clients’ company kits, and any other files held for the clients are temporarily held.   
  • Digital Security: All electronic data is stored on secure servers with firewall protection and encryption protocols. Payment transactions are encrypted using SSL technology.
  • Access Control: Access to your Personal Data is restricted to those employees, agents, contractors, and other third parties who have a business need to know.
  1. Retention of Personal Data.We will only retain your Personal Data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
  • Corporate Records: Statutory records are retained in accordance with the Companies Ordinance and Limitation Ordinance.
  • Unsuccessful Applications: Data provided for unsuccessful service applications will be destroyed within a reasonable timeframe unless you consent to its retention for future opportunities.
  1. Your Rights.Under the PDPO, you have the right to:
  • Check whether we hold Personal Data about you and to access such data (Access Request).
  • Require us to correct any Personal Data relating to you which is inaccurate, incomplete, misleading, or outdated (Correction Request).
  • Ascertain our policies and practices in relation to Personal Data.

To exercise these rights, please contact our Data Protection Officer. We may charge a reasonable fee for the processing of any data access request.
